Μια σημαντική συμφωνία για την καταπολέμηση της πειρατείας μέσω του διαδικτύου, που προβλέπει ακόμη και τη διακοπή της σύνδεσης όσων κατεβάζουν παράνομα ταινίες ή τραγούδια, υπογράφηκε στη Γαλλία.
Ο πρόεδρος της Γαλλίας, Νικολά Σαρκοζί, χαιρέτισε την υπογραφή της συμφωνίας αυτής σε μια τελετή που οργανώθηκε στο προεδρικό μέγαρο, παρουσία πολλών τραγουδιστών και ηθοποιών. Τόνισε ότι πρόκειται για "για ένα αποφασιστικό βήμα για τον πολιτισμό στο διαδίκτυο".
Στο κείμενο της συμφωνίας προβλέπεται η ίδρυση μιας διοικητικής αρχής που θα αναλάβει την καταπολέμηση της πειρατείας στο διαδίκτυο. Η αρχή αυτή θα μπορεί να στέλνει προειδοποιητικά μηνύματα σε όσους κατεβάζουν παράνομα τραγούδια και ταινίες και, σε περίπτωση υποτροπής, να τους διακόπτει τη σύνδεση.

French film and music stars could soon enjoy better protection from internet pirates. The government plans to set up a new anti-piracy body with internet providers and the entertainment industry to track those illegally downloading records and movies. Offenders could lose internet access. Denis Olivennes from France's biggest music and film retailer, FNAC, says: "I'm not talking about the big pirates, I'm talking about my children and yours. We're warning them it's illegal. No'one's going to prison or even being fined."

The scheme is still in the planning stages, but already many are disputing the practicalities of it. For example, if someone downloads via wi-fi, who gets blamed? And consumer rights experts question its legality since judge and jury would be a non-judiciary body.

"They're going to police the internet via an administrative authority that would have some of the powers of a judge. That's not exactly compatible with certain constitutional guarantees," says one.

As for the young at whom the proposals are aimed, they doubt the technology exists to really crackdown on the problem, given how easy downloading your favourite track is.

One surfer commented that when you can swap material with the click of a mouse, that short of musseling the entire planet, the authorities wont be able to do anything.

However, the entertainment industry in France believes the plans are a major step in the right direction. And other countries are watching with interest.

President Sarkozy of France is set to unveil a radical new anti-internet piracy policy under which persistent offenders will have their internet access cut off.

The measures are expected to call for the creation of a new government agency that would have the power to demand data from internet service providers. Those records would be used to identify the heaviest internet users and scrutinise for evidence of illegal downloading of films and music.

Under a “three strikes and you’re out” policy, persistent piracy offenders would have their internet accounts cut off after two warnings.


The proposals, which would put France at the vanguard of the global fight against digital bootlegging, follow a policy review by Denis Olivennes, the chairman of Fnac, the retail chain.



Illegal internet downloads have caused a plunge in Fnac's music sales in recent years. It has been estimated that a billion media files were downloaded in France last year.

Mr Olivennes said in September that he aimed to formulate an "empirical and practical" set of measures to fuel growth in legal downloads.

However, his interest in supporting the market for physical media formats such as DVDs and CDs has been noted by lobbyists for less stringent copyright rules.

UFC-Que Choisir, a consumer rights group, criticised his proposals, which it says go against the grain of the digital age, as “potentially repressive”.

France’s recorded music market plummeted in value by about 40 per cent between 2002 and 2006, according to SNEP, the industry body.

The digital market has failed to pick up lost physical sales – and actually fell by 2.3 per cent in the first quarter of this year, compared with the same period a year earlier.




PARIS, Nov. 23 (Reuters) — Internet users in France who frequently download music or films illegally risk losing Web access under a new antipiracy system unveiled on Friday.

The three-way pact among Internet service providers, the government and owners of film and music rights was drafted by a commission led by the chief executive of FNAC, a big music and film retailer in France. The industry has called for action against illicit downloads, which are cutting into its sales.

Under the agreement, service providers will issue warning messages to customers downloading files illegally. If users ignore those messages, their accounts could be suspended or closed altogether.

“We run the risk of witnessing a genuine destruction of culture,” President Nicolas Sarkozy said in a speech endorsing the deal.

He added that the Internet must not become a high-tech Wild West, “a lawless zone where outlaws can pillage works with abandon or, worse, trade in them in total impunity. And on whose backs? On artists’ backs.”

An independent authority, supervised by a judge, will be set up and put in charge of deciding when to issue electronic warning messages to Internet users.

The deal also creates obligations for film and music companies to make their works available online more quickly and to remove technical barriers like those that make music tracks unreadable on certain platforms.

The international recording industry hailed the move.

“This is the single most important initiative to help win the war on online piracy that we have seen so far,” said John Kennedy, head of the industry’s trade body IFPI.

“President Sarkozy has shown leadership and vision. He has recognized the importance that the creative industries play in contemporary Western economies,” Mr. Kennedy said in a statement.

Consumer groups and politicians in France, however, have said the deal, which was signed by several companies on Friday, is too restrictive.

The consumer group UFC Que Choisir said in a statement that the deal was “very tough, potentially destructive of freedom, antieconomic and against digital history.” The group argued that tough antipiracy penalties were already in place.

Mr. Sarkozy said that it would take time for the effects of the new system to become clear, but that it would achieve its aims. “If it works, we will carry on the same way,” he said. “If it does not work well enough, we will take the measures to obtain results.”

Ε, καλά! Βλακείες. Πραγματικά δεν καταλαβαίνω γιατί τόσος χαμός;;; Πρέπει να το πάρουν απόφαση όλοι οι τραγουδιστές και γενικά τα πρόσωπα του θεάματος ότι η πειρατεία δεν υπάρχει περίπτωση να καταπολεμηθεί. Οι ίδιοι που θα κατεβάσουν τις ταινίες και τα τραγούδια τους μέσω κάποιου P2P προγράμματος είναι οι ίδιοι που θα τα αντέγραφαν και θα τα κατείχαν πάλι πειρατικά ακόμα και αν δεν υπήρχαν τα προγράμματα αυτά.
Και μην πάμε μακριά, θυμάμαι τις εποχές που δανειζόμασταν τα τότε πρωτοπόρα CD μουσικής προκειμένου να τα αντιγράψουμε σε κασέτα και να χαιρόμαστε ή τις πατέντες με 2 βίντεο για να αντιγράψουμε μια ταινία που είχαμε πάρει από το βίντεο κλάμπ. Εποχές...!!!

Πίσω στο θέμα μας.
Εγώ αυτήν την κίνηση την θεωρώ βλακεία. Πιο καλό είναι να κοιτάξουν το λόγο που γίνεται η πειρατεία παρά να προσπαθούν να την πατάξουν με ακραία μέτρα. Πείτε μου ποιος δεν θυμάται τις ηρωικές δηλώσεις ότι τα dvd είναι κλειδωμένα και ΔΕΝ αντιγράφονται όσο και να προσπαθήσει κάποιος; Το είδα.....

Εμένα αυτό που με απασχολεί είναι άλλο. Οι providers δλδ θα μπορούν να δίνουν τις πληροφορίες κάθε χρήστη παραέξω; Δλδ θα ξέρει ο άλλος εγώ ποια site επισκέφτηκα και ξέρω γω και τι άλλες προσωπικές πληροφορίες; Σε λίγο θα μας πουν ότι για να πατάξουν την πειρατεία θα είμαστε υποχρεωμένοι να τους αφήνουμε να μπαίνουν στον υπολογιστή μας και γιατι όχι ακόμα και στα σπίτια μας. Καλά οκ λίγο υπερβολικό. ΑΛλά όπως και να το κάνουμε δεν είναι δυνατον να μας κατασκοπεύουν από παντού ποια και να έχουν και το νόμο με το μερος τους.

Despite more than 20,000 lawsuits filed against music fans in the years since they started finding free tunes online rather than buying CDs from record companies, the recording industry has utterly failed to halt the decline of the record album or the rise of digital music sharing.

Still, hardly a month goes by without a news release from the industry's lobby, the Recording Industry Association of America, touting a new wave of letters to college students and others demanding a settlement payment and threatening a legal battle.

Now, in an unusual case in which an Arizona recipient of an RIAA letter has fought back in court rather than write a check to avoid hefty legal fees, the industry is taking its argument against music sharing one step further: In legal documents in its federal case against Jeffrey Howell, a Scottsdale, Ariz., man who kept a collection of about 2,000 music recordings on his personal computer, the industry maintains that it is illegal for someone who has legally purchased a CD to transfer that music into his computer.

The industry's lawyer in the case, Ira Schwartz, argues in a brief filed earlier this month that the MP3 files Howell made on his computer from legally bought CDs are "unauthorized copies" of copyrighted recordings.

"I couldn't believe it when I read that," says Ray Beckerman, a New York lawyer who represents six clients who have been sued by the RIAA. "The basic principle in the law is that you have to distribute actual physical copies to be guilty of violating copyright. But recently, the industry has been going around saying that even a personal copy on your computer is a violation."

RIAA's hard-line position seems clear. Its Web site says: "If you make unauthorized copies of copyrighted music recordings, you're stealing. You're breaking the law and you could be held legally liable for thousands of dollars in damages."

They're not kidding. In October, after a trial in Minnesota -- the first time the industry has made its case before a federal jury -- Jammie Thomas was ordered to pay $220,000 to the big record companies. That's $9,250 for each of 24 songs she was accused of sharing online.

Whether customers may copy their CDs onto their computers -- an act at the very heart of the digital revolution -- has a murky legal foundation, the RIAA argues. The industry's own Web site says that making a personal copy of a CD that you bought legitimately may not be a legal right, but it "won't usually raise concerns," as long as you don't give away the music or lend it to anyone.

Of course, that's exactly what millions of people do every day. In a Los Angeles Times poll, 69 percent of teenagers surveyed said they thought it was legal to copy a CD they own and give it to a friend. The RIAA cites a study that found that more than half of current college students download music and movies illegally.

The Howell case was not the first time the industry has argued that making a personal copy from a legally purchased CD is illegal. At the Thomas trial in Minnesota, Sony BMG's chief of litigation, Jennifer Pariser, testified that "when an individual makes a copy of a song for himself, I suppose we can say he stole a song." Copying a song you bought is "a nice way of saying 'steals just one copy,' " she said.

But lawyers for consumers point to a series of court rulings over the last few decades that found no violation of copyright law in the use of VCRs and other devices to time-shift TV programs; that is, to make personal copies for the purpose of making portable a legally obtained recording.

As technologies evolve, old media companies tend not to be the source of the innovation that allows them to survive. Even so, new technologies don't usually kill off old media: That's the good news for the recording industry, as for the TV, movie, newspaper and magazine businesses. But for those old media to survive, they must adapt, finding new business models and new, compelling content to offer.

The RIAA's legal crusade against its customers is a classic example of an old media company clinging to a business model that has collapsed. Four years of a failed strategy has only "created a whole market of people who specifically look to buy independent goods so as not to deal with the big record companies," Beckerman says. "Every problem they're trying to solve is worse now than when they started."

The industry "will continue to bring lawsuits" against those who "ignore years of warnings," RIAA spokesman Jonathan Lamy said in a statement. "It's not our first choice, but it's a necessary part of the equation. There are consequences for breaking the law." And, perhaps, for firing up your computer.
